外国人在中国就业的注意事项


As more and more foreigners are coming to China to pursue their careers, they should be aware of the provisions of employment laws in China.

随着越来越多的外国人来中国追求自己的事业,他们应该了解中国就业法的规定。

 Here below, Attorney_Jingzhan will give you some legal advice about getting employed or unemployed in China:

Question 1: What does a foreigner need to apply for when coming to China to look for a job?

问题1:外国人来中国找工作需要申请什么?

Answer: generally speaking, work permit and residence permit are needed for getting employed in China.

答:一般来说,在中国就业需要工作许可证和居留许可。

Question 2: what should be in your mind in entering into an employment relationship?

问题2:你在建立雇佣关系时应该考虑些什么?

Answer: keep in mind that you need to negotiate with the employer in aspects of role, salary, time, location, and etc.

答:请记住,你需要与雇主在角色、薪水、时间、地点等方面进行谈判。

 By making an agreement, you should sign a written contract with the Employer and don’t forget to ask a copy of it.

通过签订协议,你应该与雇主签署一份书面合同,不要忘了要一份合同副本。

 The original contract will be critically important if any disputes rise thereafter.

如果此后发生任何争议,原始合同将非常重要。

Question 3: Does the company and the employed foreigner need to pay for social insurance in China?

问题3:在中国,公司和被雇用的外国人是否需要支付社会保险费用?

Answer: Yes.

答:是的。

 As per the laws and regulations, companies or other organizations that employ a foreigner need to make sure that they’ll make a registration of the insurance for the foreigner employees.

根据法律法规,雇用外国人的公司或其他组织必须确保为外籍雇员办理保险登记。

 The social insurance includes: retirement insurance, work injuries insurance, medical insurance, unemployment insurance, and maternity insurance.

社会保险包括:退休保险、工伤保险、医疗保险、失业保险和生育保险。

 Paying for social insurance is not only a right, but also an obligation.

支付社会保险不仅是一项权利,而且是一项义务。


Question 4: For the employees, how to terminate the employment contract?

问题4:对员工来说,如何解除雇佣合同?

Answer: The employment contract may be terminated in the cases that:

答:在下列情况下,雇用合同可以终止。

 1.mutual consent;相互同意

2.the employee’s notification of termination 30 days ahead of time, or 3 days ahead of time during the probation.雇员提前30天或试用期提前3天通知解雇。

 3. the employee’s quit due to that:

员工辞职的原因是:

·Absence of working conditions and violating provisions of contract,

·没有工作条件,违反合同规定,

· Untimely or insufficient payment,

·付款不及时或不足,

· No social insurance,

·没有社会保险,

· Employer’s regulations/policy break laws and undermine employees’ interests.

·雇主的规定/政策违法,损害员工利益。

 ·The contract is null and void because of breaking mandatory rules.

由于违反强制性规定,合同无效。

· Besides, if the employer, by way of violence, threatens or illegal detention, forces the employee to work, or endanger the employee’s safety, the employee could leave without notice.

此外,如果雇主以暴力威胁或非法拘留,强迫雇员工作,或危及雇员的安全,雇员可以不经通知而离开。

Question 5: what would be the legal process in the situation that a dispute couldn’t be resolved by negotiation?

问题5:在不能通过谈判解决争端的情况下,法律程序将是什么?

Answer: when such dispute is raised, the employee could apply for employment arbitration and, furthermore, the employee has the right to file a lawsuit if he thinks the arbitration decision isn’t justified.

答:当提出争议时,员工可以申请就业仲裁,此外,如果员工认为仲裁裁决是不正当的,则员工有权提起诉讼。
